Terms and Conditions

The rules for using the CheckInKYC website and service.

Draft for legal review. The highlighted items in square brackets still need the owner's details, and a lawyer should check this page before launch.

1. Who we are and what these terms cover

CheckInKYC is a paperless guest check-in and Aadhaar offline verification service for hotels. It is operated by SWASTIK ENTERPRISES ("we", "us"), a UIDAI-registered Offline Verification Seeking Entity (OVSE), registration number OR11274063. Our address is [REGISTERED ADDRESS].

These terms apply to this website and to the CheckInKYC service used by hotels, their staff and their guests. If you use the service for a hotel, you confirm that you are allowed to accept these terms for that hotel. If you do not agree, please do not use the website or the service.

2. The service

CheckInKYC lets a hotel show a QR code at reception. The guest opens a secure page on their own phone, agrees to the notice, and verifies their identity. Today the digitally signed Secure QR on an Aadhaar card or e-Aadhaar is supported. The Aadhaar App route is being enabled and will be offered only after the approvals it needs are in place. Reception can also check a guest in with another ID. The hotel keeps a digital guest register, a record lookup and an audit log.

We may improve, change or add features. We will try to give notice of a change that removes something a hotel relies on.

3. Free trial

  • A free trial lasts 15 days from the day we set up your hotel [CONFIRM: no card or payment details are taken for the trial].
  • During the trial the hotel may use the service for real check-ins, and the same terms apply.
  • At the end of the trial the service stops for the hotel unless it has subscribed. We will contact the hotel before that date.
  • We may decline, shorten or end a trial where we think it is being misused.

4. Fees

Subscription plans, prices, taxes and billing periods will be agreed with the hotel in writing before it subscribes. Prices shown on the website are illustrative and subject to final confirmation. [CONFIRM: GST, billing cycle, payment method and refund terms.]

5. What the hotel is responsible for

CheckInKYC is a tool. The hotel stays responsible for its own legal duties and for how it uses the service. In particular, the hotel agrees that it will:

  • use the service only for lawful guest identity verification and its own guest records, and for no other purpose;
  • keep its guest register and make any police, local authority or foreign-guest (Form C) reports that the law requires of it. CheckInKYC does not file these for the hotel and does not decide what the law requires;
  • tell each guest what is collected and why, show the privacy notice, and never make a guest feel forced. A guest who prefers not to use Aadhaar must be offered another way to check in;
  • compare the photograph with the person at the desk and use its own judgement before accepting a guest;
  • keep staff log-ins private, remove staff who leave, and tell us quickly if it thinks an account has been misused;
  • keep to the retention period it sets and not copy guests' details into other systems, paper files or messaging apps without a lawful reason;
  • follow the conditions that UIDAI sets for offline verification entities, which we will pass on to the hotel where they apply to it.

6. Guest information and data protection

The hotel decides why and how long it needs its guests' details. We handle that information on the hotel's behalf to provide the service, and as an OVSE for the verification itself. Our Privacy Policy explains what we collect, how we protect it and what rights people have. [LAWYER: confirm the roles of hotel and operator under the DPDP Act 2023 and sign a data-processing addendum with each hotel if advised.]

7. What we do not promise

  • CheckInKYC supports hotel record-keeping. We do not certify that a hotel is compliant with any law. UIDAI has not endorsed or approved the hotel's use of the service, and nothing on this website says so.
  • A "verified" result means the digital signature on the document or credential checked out. It does not replace the hotel's own check that the person in front of it is the person in the photograph.
  • The website and blog explain public information from UIDAI and others in plain words. They are not legal advice. Please ask your own lawyer about your hotel's duties.

8. Acceptable use

You must not misuse the service. For example, you must not try to break into it or test its security without our written permission, put malicious code into it, copy or resell it, use it to collect people's details for another purpose, or use it in a way that breaks the law or another person's rights.

9. Availability

We work to keep the service running and we back it up, but we cannot promise it will never be interrupted. UIDAI's own systems, a guest's phone or an internet connection may fail. Hotels should keep a manual way to check in guests.

10. Suspension and ending

A hotel may stop using the service at any time by telling us. We may suspend or end access if these terms are broken, if the law or UIDAI requires it, or if a payment is overdue after notice. When a hotel's account ends, we will delete its guest data after the retention and export period agreed with it, except where the law requires us to keep something. [CONFIRM: export period.]

11. Ownership

The CheckInKYC name, logo, website, software and content belong to us or our licensors. The hotel's guest records remain the hotel's. The Aadhaar name and logo belong to UIDAI.

12. Limit of our responsibility

To the extent the law allows, we are not responsible for indirect or consequential loss, or for loss caused by the hotel not following these terms or the law. Our total responsibility for any claim relating to the service is limited to the fees the hotel paid us in the 12 months before the claim. Nothing in these terms limits a responsibility that cannot legally be limited. [LAWYER: review this section.]

13. Governing law

These terms are governed by the laws of India. The courts at [CITY], India will have jurisdiction, subject to any right a person has by law to go elsewhere.

14. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If the change matters to a hotel that already uses the service, we will tell it.

15. Contact
